ANALISIS KRITIS TERHADAP PEMBAGIAN PERAN SUAMI ISTERI DALAM HUKUM ISLAM POSITIF DI INDONESIA

Abstract


The household is an element that only consists of the community consisting of husband and wife. Men and women have no difference, are interdependent on each other's position that are interrelated and cloudy with each other. But then in Islamic Law in Indonesia which was legalized in the form of Compilation of Islamic Law and Law No. 1 of 1974 strengthened the position of the wife where women are under the supervision and dependents of the husband who is always required to support and serve the husband. The wife is a housewife while the husband is the head of the household. This position has implications for women's sosial life. Finally, women are ensnared in dual roles in the domestic and public sphere. Though the Koran itself has never forced that role even the school of thought scholars too. This study uses a normative juridical method with gender equality approach, which is conducted according to the rules regarding the rights and obligations of the husband
